| Strengthening the implementation and enforcement of smoke-free policy: Fining structure should be improved |

On May 27th 2010, Vietnam Public Health Association (VPHA) held the conference “Strengthening the implementation and enforcement of smoke free policy in Vietnam.” The experts of tobacco control organizations, Department of Legal affairs in Ministry of Health, Hanoi Department of Judiciary and about 30 journalists in Hanoi participated in the conference. During the conference, the result of surveys of VPHA found out the percentage of smoking of male employees was still high (above 45%). The rate of violation of legislation to ban smoking is indeed serious. In Decision number 1315/QĐ-TTg on August 21st 2009 of Prime Minister, smoking in public place was a punishable offence. In fact, the result of a public poll which VPHA conducted in April 2010 showed that the violation rate in coach stations, train stations was above 75%, in schools, in hospitals was about 60%, and, in offices, 80%. At the conference, the representative of Chi Linh district Clinical Hospital (Hai Duong province) shared their experience in implementing the “Smoke-free hospital” Model. According to Dr. Le Quang Tao, Vice President of Trade Union, hospital authorities established Steering Committee to run Decision no. 1315/QD-TTg. They monitor each region and invited 2 policemen to help the hospital fine smokers. Most of participant agreed one of the reasons of breaking the legislation in public place were troubles in punishing. The fining structure is available but the fining officers are lacking. To improve the implementation of smoke-free policy, it is necessary to improve the implementation structure and give the authority to punish people to more officials. According to VPHA coordinator Mrs. Nguyen Ngoc Bich, based on the result of discussion in the conference, VPHA will make position statements to provide policy makers with information, recommendations on strengthening the implementation and enforcement of the smoke free policy to contribute to the protection of community health. |
